General

1.1 All services from the online store UVI.GG, are in line with the Consumer Protection Act (ZVPot-UPB2) and based on international codex along with recommendations from GZS, and are performed by legal entity LEGIT D.O.O., registration number 7140053000, Brnčičeva ulica 13, 1000 Ljubljana – Črnuče, Slovenia, VAT number SI52069869 with entry number in the register SRG2016/39005 (in the document referred to as the “provider”).

1.2 The client, customer, buyer, or user from here on out mean: end-user, self-employed business owner, a company, or an organization that the provider provides a service to.

1.3 Terms and Conditions apply to all services that the provider is offering and deal with all the user’s rights, operation of UVI, and all legal or business relations between the provider and the buyer, in all operating conditions.

1.4 A customer, that wants to make a purchase at the UVI website or get the right to do so, does not need a registered account, but can always create one. The username of the account is the same as the e-mail address entered. The username and password, which the customer receives via e-mail confirmation, unambiguously define and bind the user with the entered data. The user can change his password independently at any time. Any change of username or e-mail address must be done via a request message to [email protected]. The user will be informed via e-mail when the change to his/her account has been made.

The obligation of the provider and the client

2.1 The data and information provided on the UVI website are accurate. There may be an error with certain records, statements or information due to changes in technologies of the devices our products operate on (computers, phones, consoles…). If you find any incorrect information, record, or a statement, please inform us. If your decision for purchase was based on the wrong information provided by the site, you can return your product.

2.2 The provider commits, that the services will be performed with the best possible quality and in the agreed time frame.

2.3 The provider commits that he will always provide the customer with:

Identity of the company (Name, registered address and the registration number)
Contact information for a fast and efficient communication ( e-mail, telephone…)
Key facts of the goods or services (including after-sales services and warranties)
Access to goods that are offered (in a reasonable time frame)
Terms of delivery of goods or execution of services (place, method and time of delivery)
Clearly and unequivocally listed prices, with clear information if the rate includes VAT and cost of shipping (in checkout stage)
Method of payment and delivery
Time validity of the offer
Time period during which is still possible to withdraw from the contract and terms for the withdraw (including if there is any cost involved in the withdraw from the contract)
Explanation of the procedure on appeal (along with all the contact information of the customer service)

2.4 Entry of personal data during registration or at purchase at the web store UVI is exclusively used for the proper execution of services. The provider will never forward, lease, sell, or in any other form trade your personal information. In addition, your personal information will never be used in any way that you might not support or agree with.

2.5 All orders accepted before 8:00 (CET) will be addressed as orders accepted that day, and the delivery date will start counting from that day. Agreed delivery dates can change in case of force majeure, like natural disasters, longer electrical or internet connection cutouts.

Changes in terms and conditions

3.1 UVI holds all the rights to change the terms and conditions without further notice. Changes come into effect at the moment they are published on the web store and are valid from that time onwards. Terms and conditions are always available on the UVI website. For any questions about terms and conditions, we are available at [email protected].

3.2 By using the services and registering at the UVI webshop you agree, that you are fully aware and agree to all listed terms and conditions.

Offered products and services

4.1 Due to the nature of the business being done over the world wide web there are often frequent and quick changes to provided services and products. In the case of a reported mistake or incorrect information on the UVI website, we accept the responsibility for resolving the error or complaint.

Ordering and purchase procedure

5.1 In the UVI web store products are exclusively sold online via the internet. All placed orders are considered final. In case of a wrong order or cancellation of the order, the buyer can correct or cancel his order only until he gets an e-mail message “Your order at UVI is complete”. Once the buyer gets an e-mail message stating his order is completed, cancellation of the order is no longer possible. Provider reserves the right to cancel and refund the order in cases where the order can not be carried out under terms and conditions (unavailability of the product ordered, longer delivery time frame, or in case of EOL – when products have been discontinued). Cancellation of the order by the provider can occur before the customer receives the e-mail message “Your order at UVI is complete”.

5.2 Ordering procedure is as follows:

The customer adds the product to the cart on the UVI website.
The customer is automatically redirected to the cart page, where all products added to the cart can be seen.
The customer clicks »Continue with order« or »Proceed to checkout«, which transfers the buyer to the checkout page.
The customer fills in all the required fields (name, surname, address, phone number, email address) or logs in to an existing account. A user account is not required for the purchase.
Customers can choose between different payment methods: credit cards, PayPal, direct bank transfer, payment on delivery, payment at personal pick up (the latter three options are available for selected countries).
The customer must agree to the general terms and conditions before he/she can complete the purchase.
In case the customer does not fill in all of the required fields, the system will clearly display the warning and highlight the missing fields.
After completing the purchase the customer will receive a confirmation email.
If the customer has a registered UVI account his/her order information and status can be checked on the UVI website. Customers will also receive further order information by email.
The provider will review the order (check the deadline and the possibility of delivery of the ordered items). In some cases, the provider can contact the customer via phone or email to double-check provided information to ensure correct delivery.
After the order is completed the customer will receive a confirmation email status »Your order at UVI was completed«, and his/her order status will change to »Completed«. The email will contain all needed information who the customer can contact in case of delayed delivery, return of goods, and in case of a complaint ([email protected]).
Delivery time is tied to the partners performing the delivery (Pošta Slovenije, GLS, or DHL) and in most cases lasts from 1-3 working days for Slovenia and Croatia and 3-21 days for other countries.

For the goods that the provider does not have in stock or his storage, delivery time is exclusively bound to the delivery terms and times of the provider’s supplier. The provider will update the buyer on the latest known delivery dates. If the delivery period is very long and the buyer does not want to wait, the buyer can notify the provider, who will remove the item from the order, refund any funds already paid, and deliver other items from the order or cancel the entire order based on customer’s preference. If the supplier informs the provider, that the delivery of the goods is three months or more, the supplier will cancel the buyer’s order on the grounds that the goods are not available. On the day of the order rejection, the buyer’s order is canceled. The provider does not take any responsibility for any damages that would occur due to the long delivery times or due to the non-delivery of the goods, that the provider does not have in stock in its warehouse.

Prices

6.1 All of the prices in the UVI web store include VAT for EU customers unless explicitly stated otherwise. Prices in the web store are valid only for orders made via the web store and for orders paid with cash on delivery or via pick up (only available for selected countries). In some promotional cases, registered users can have a special promotional discount or price.

6.2 Prices are valid at the time of the submitted order and do not have predetermined validity. Prices are only valid with the above-mentioned payment methods under the above-mentioned terms and conditions. The shipping cost for Slovenia is 4 € and for Croatia is 5.5 €. Shipping cost for other countries is calculated and displayed in the cart and on the checkout page.

Contract of sale between the buyer and provider is made at the moment when the provider confirms the buyer’s order and the buyer receives an e-mail message “Order confirmed”. From that moment onward prices and other terms are fixed, can not change, and are applied to both the provider and the buyer. Discounts and promotional codes do not add up together. The credit of the registered users at UVI and all paid funds via proforma invoice are not interest-bearing.

Withdrawal and Returns

7.1 The customer has the right to withdraw from the purchase within 14 days of receiving the goods, signing a contract, or after a finished service. The customer has to inform the provider in written form over a mail or e-mail or send the completed withdrawal form (download here), without having to state the reason. The return period starts one day after the date of customer acquires possession of the goods. The only expense the buyer has with the withdrawal from the offer is the cost of the return shipment of the goods. The goods must be returned to the provider no later than 14 days from the submission of the withdrawal from the contract, and the provider must immediately refund the buyer in full. A refund of payment is made via the same payment option that the payment was received unless the customer wants a different refund method or if the original refund method is not possible. We do not accept return shipments with a charge on a collect basis! A refund is made within 14 days after the provider receives the returned goods. After a 14-day return period, the return of goods is no longer possible.

The returned goods must be undamaged, in the same state, and in the same amount as received, except in cases, where the goods were damaged, lost, broken or its amount changed and it was not the fault of the customer.

If the product was custom made for the customer or the order was customized to the customer’s wishes, withdrawal from the contract is not possible.

The customer can express his rights arising from the product defect if he notifies the seller about the defect within two months from the day that the defect was discovered. The provider is not responsible for any defects that appear two years or later after the goods were delivered to the customer.

Security, personal data protection and communications

8.1 The provider uses appropriate technological and organizational resources for the protection of transmission and saving of personal data and payments. For this purpose, the provider uses an SSL certificate issued by an authorized organization. Safe authorization and credit card transactions are handled by UVI, Paypal, or Adyen. Authorization of credit cards is done in real-time with immediate checking of the data with the bank. Credit card numbers or any other information about payments made online are not saved.

We will, in all circumstances, safeguard personal information as set out in this Privacy Policy. The information you provide when registering and ordering goods will be carefully protected.

The provider saves IP addresses from all visitors on the UVI webshop for an indefinite period of time. The providers saves the following information of registered users: name, surname, e-mail address, contact phone number, primary address, shipping address, country of living, time and date of registry, and archive of the communication with the provider.

The provider uses that data exclusively for executing orders (sending informational material, offers, invoices) and all other needed communication with the buyer.

The buyer’s data will not be given, shared nor sold to any unauthorized personnel. However, it is also the responsibility of the buyer to keep his/her personal data safe by keeping his/her username and password protected and using proper antivirus software on his/her device.

8.2 Provider will get in contact with the customer via distance communication unless the customer explicitly objects.

Promotional email messages will contain:

clearly presented message from the provider,
a clear indication of the message as an advertising message,
a clear indication of various promotions, campaigns, and other marketing techniques,
a clear indication of how to participate in them,
clearly presented method of unsubscribing from receiving advertising messages.

If the customer states that he/she does not want to receive any advertising messages the provider will respect his decision and abide by it.

8.3 Customers’ comments and product ratings, that are written by customers, are a part of the store’s functionality. They are meant for the community of users. Comments can be written by any registered user of the UVI store. The provider holds the right to delete or reject any insulting, inappropriate, or useless comments posted on the website before final publication. With the posting of a comment, the user fully agrees to the terms and conditions and allows the provider to publish a part of the whole text in the comment in all electronic or other media. The provider has the right to use the text for an unlimited time period and in any manner that is in the commercial interest of the provider, including publishing it in ads and other marketing communications. The author of the comment also agrees that he is the owner of the material and moral copyrights of the comments and that transfers those rights to the provider – non-exclusively and indefinitely. By placing an order, the customer agrees to receive a one-time electronic invitation to submit an opinion for the ordered products.

Warranty and service

9.1 The warranty period begins with the day of the delivery or pick up of the ordered goods. Warranty is provided by the manufacturer or the importer, who is responsible for the warranty terms. You can only claim the warranty for products purchased directly from the UVI store.

The warranty of an item is stated on the attached warranty note or on the invoice. The warranty is not valid for software and consumables that are subject to constant use or wear (like tapes, toners, batteries, etc….). An item that breaks down in the warranty period, will be repaired, or replaced within 30 days or less. If this is not possible, the item will be replaced with a new one at the buyer’s request or if the replacement is not possible, the funds will be returned to the customer.

Items that are delivered for repairs after the warranty period has expired, will be repaired or will be sent for repairs to the official service provider in the shortest time period after agreement with the buyer. With that, the customer takes over all the expenses involved in the repairs (work, material, transport, etc…). Service work and material are charged according to the valid price rate of UVI or official service provider. In the case of the replacement of the goods, the switch is made only after the payment of the goods. The customer can pick up the goods only after payment of all charges involved.

The warranty period of each item is listed in the detailed description. The general warranty for all items is 2 years, unless for items where otherwise stated. Warranty is not valid for consumables and beverages. The warranty can be claimed with the original invoice, a copy of the original invoice, or with the warranty card. You can return the defective goods to the provider’s store or send them directly to an authorized service center. The warranty is voided in case of improper use, mechanical damage, service done by non-authorized personnel… If there is no info about the warranty the item has no warranty or there is no data about the item having a warranty at that moment. In that case, the customer can contact the provider, who will provide accurate information.

After the expiration of the warranty, we offer service in exchange for payment. You can obtain the cost or offer for repair via e-mail support.

Payment methods

10.1 By placing an order in the UVI online store the customer is bound to pay the purchase price in the selected manner. The provider allows the following methods of payment:

payment in advance by direct bank transfer based on sent invoice or quotation (only selected countries, the online price applies)*,
payment via Paypal (Payment through Paypal has 3% fee due to added cost for the provider),
payment on delivery directly to the delivery service (only selected countries),
Adyen payment with Credit Cards (MasterCard, VISA, AE, Diners, Maestro…).

* For individual orders, we reserve the right to request payment by bank transfer to the UVI bank account (according to the offer / proforma invoice, where the online price still applies).

10.2 The provider issues an invoice to the customer on a durable medium, with listed costs and instructions. The customer is responsible for checking the correctness of the data on the invoice and reporting possible errors to the provider 8 days after receiving the receipt. Subsequent objections regarding the correctness of issued invoices will not be accepted. Contract of sale (customers order with status “Completed”) is saved in electronic form on the provider’s server and is accessible to the customer at any time in the customer’s user profile (account). The provider is obliged to issue an invoice to the customer.

Delivery

11.1 The provider will deliver the goods or services within the agreed-upon time. Contractual partners for the delivery of orders are Pošta Slovenije*, GLS*, Overseas Express or DHL, but the provider holds the right to use a different delivery service. In case of accepting goods over a delivery service, please be sure to sign the accompanying documentation.

If the customer chooses to pay upon delivery (available for some countries) he/she must pay the full cost of delivered goods and the delivery charges directly to the delivery company. In some countries shipping costs for orders over 200 € are covered by the provider. Upon the delivery of the goods, the customer is responsible to visually inspect the goods for any damages – on both the packaging and the items themselves. With the purchase and selection of the delivery by delivery service the customer agrees, that to ensure easier communication between the customer and delivery service, the phone number he/she provided at the time of purchase will be written on the delivery form.

All in-stock orders will be shipped within 1-5 business days of placing the order unless it is a custom or combined order.

* Pošta Slovenije d.o.o. and GLS enable payment in cash or with Mastercard, Maestro, Visa, Karanta, and Diners Club Slovenija cards (Diners Club also in installments – Pošta Slovenije). When paying with certain credit cards via Pošta Slovenije, you may incur additional costs charged by Pošta Slovenije.

Software

Some products have a software option that you can download for free from the official UVI website.

Privacy Policy

13.1 Personal data of our users is one of the areas where we pay special attention. We make sure that every demand is met, and in some cases even exceeded, since security of  your private information are our number one priority.

The administrator of the online store/website is obliged to protect the personal information of its users in compliance with the Personal Data Protection Act (ZVOP-1-UPB1).

The provider collects the following user data for the needs of the online store:

name and surname,
address,
email address (your user name),
contact telephone number,
password in encrypted form,
and other data user enters into forms on the website.

The provider is not responsible for the accuracy of user-provided information.

13.2 To ensure website safety provider collects IP addresses, from which users access the website. At the beginning of the visit, every user is assigned a session cookie to identify and monitor the shopping cart. The website may also store other cookies to your computer, like user identification numbers in encrypted form (to identify the user on the next visit), item ratings (to know which items you already rated), and Piwik system cookies (analysis of visits of websites, hosted on our servers).

All mentioned information, except cookies, are saved permanently on the server. Session cookies are saved on the server only for the duration of the visit and are deleted after one hour of inactivity. Permanent cookies are stored on the visitors’ computers.

The provider can use the data in anonymized summary form for statistical analysis. Under no circumstances will the provider pass the data to unauthorized persons or entities. Delivery service will receive only the necessary information to successfully deliver the order (name, surname, email, phone number, and price amount in case of payment upon delivery). We will contact the user via means of distance communication only if the user does not explicitly object to this.

13.3 Exceptional disclosure of personal information.

Any and all information we collect and process will only be revealed if required by law or in good faith that such action is necessary for proceedings before courts or any other state bodies and the protection of the legitimate interests of UVI and the provider.

13.4. Deletion, unsubscribtion and request to print data.

User can always unsubscribe from receiving electronic marketing messages. Unsubscription option will be clearly visible in the footer of every recieved email (»Unsubscribe«). With clicking on the link user will be unsubscribed from receiving any additional electronic marketing messages. Due to the nature of the functionality of the website, the user will always recieve an email in case of a request for a forgotten password. Users can demand deletion of all information saved on the provider’s server linked to the sender’s email by sending DELETE MY INFORMATION AT UVI email to [email protected]. Due to the nature of the functionality of the website we reserve the right to remove all user data (email name/nickname, other data that user can enter in the profile) and replace them with automatically generated email address and name, that have no connection to the original data. All other data will be deleted or replaced by automatically generated characters.

13.5. Users can enter additional data in the profile, which is visible to the public, except in cases where stated otherwise.

All contact forms on the website serve only for communication and entered data is not used for any additional use (example: sending promotional electronic messages) except in cases where stated otherwise.

All possible disputes related to your purchase will be resolved by a competent court in Ljubljana, Slovenia. We do not recognize any contractors for out-of-the-court settlements of consumer disputes (click-me). For additional information, we are available via [email protected].

Additional information about privacy and cookies

The Electronic Communications Act (Official Gazette of the RS No. 109/2012), ZEKom-1, introduced into the legal system new rules regarding the use of cookies and similar technologies for storing information or accessing information stored on a user’s computer or mobile device.

The privacy of our users is very important to us, so we strive to provide users with all of the information about the cookies we use on our website to enable a better website performance and a more enjoyable user experience.

We will carefully protect any obtained information and data and exclusively use them for the needs of providing services.
